The Republic of Texas San Augustine County
In the name and by the District Court
Authority of the same March term 1841
The Grand Jurors of the Republic of Texas duly empannelled (sic) and sworn in and for the body of the County of San Augustine upon their Oath present that Elisha Elison late of the County of San Augustine on the twenty fifth day of February in the year of our Lord one thousand eight hundred and forty one in the County of San Augustine and within the jurisdiction of the district Court of the fifth judicial district, with force and arms in and upon Nancey a negro woman being the property and slave of one Philip A. Sublett, then and there being did make an assault and with certain rods whips and sticks her the said Nancey did then and there violently cruelly and imoderately (sic) beat scorge (sic) and strike and did then and there with a certain knife which he the said Elisha Elison held in his right hand then and there held in and upon the said did make and assault and did give to her the said Nancey one dangerous stroke or blow which said stroke or blow, given as aforesaid did give to her the said Nancey one grievous and dangerous wound in and upon the left side of her the said Nancey of the depth of one inch and the length of two inches and was then and there by reason of said wound put in great danger of losing her life and other wrongs to her the said Nancey he the said Elisha Elison then and there unlawfully wickedly and maliciously did to the great damage of her the said Nancey to the evil and pernicious example of all others in like cases offending and against the form of the statute in such cases made and provided and against the peace and dignity of the Republic

| Biographical Note | About 1928 San Augustine County officials tore down their courthouse to make way for a new building. Rather than move all the public records to the new courhouse, they hauled away those they deemed expendable to gullies, where they were mixed with rubble from the old courthouse. A few citizens managed to rescue what they could, leaving the rest to the elements. In 1929, a historically-minded citizen of San Augustine, Horace E. Wolcott, wrote to the then Stephen F. Austin State Teachers College. He described how he came into possession of some of the documents, offering them for a small fee to the College. The College did pay the small amount asked and obtained the collection. (Wolcott, Horace E. to Rev. George L Crocket, ALS, 28 December 1929. | Scope and Content Note | The collection at the East Texas Research Center consists of miscellaneous loose papers, mostly of records of the San Augustine District Court. The records include criminal and civil cases, promissory notes and accounts, some oaths to the Board of Land Commissioners, estate records, treasurer warrants, tabular statements of schools, letters, and manifests. A detailed list of inventory is included in the volume San Augustine County, Texas Courthouse Records and Loose Papers 1831-1906, Inventory and Index, available in the ETRC. |
